Effective March 17, 2017 employers in Washington, DC are restricted from using credit reports in any capacity to make a hiring decision. The restriction is not applicable to law enforcement officials or others personnel requiring security clearance, financial institutions, and jobs where law requires a credit check. Violators can be penalized by the DC Office of Human Rights (OHR) up to $5,000 per violation. Read More
Ninth Circuit Rules “Willfull” FCRA Violation
Concerning Syed v. M-I LLC, the Ninth Circuit Appeals Court recently ruled against the employer for including a liability waiver in the background check authorization form, a form procured by a third party screening company. Furthermore the court found, “[i]n light of the clear statutory language that the disclosure document must consist ‘solely’ of the disclosure, a prospective employer’s violation of the FCRA is ‘willful’ when the employer includes terms in addition to the disclosure, such as the liability waiver here.” Willful violations allow for actual, statutory and punitive damages along with reimbursement for attorney’s fees and other costs.
