California’s new Ban the Box regulation became on effective July 1, 2017. Questions concerning an applicant or employee’s criminal past will now be subject to new regulation. The law also raises the bar that employers must clear in order to ask criminal record-related questions to applicants and employees. Read More.
Indiana Governor issued an executive order that excludes criminal history from certain government job applications. Starting July 1, initial employment applications within the executive branch will no longer ask applicants if they have been convicted of a crime unless a conviction of a particular crime precludes that individual from employment in that specific job. Employee’s prescribed medical marijuana are now protected in Massachusetts. The state’s supreme court declared that workers dismissed for positive drug tests can launch anti-discrimination suits against their former employers. Massachusett’s voters approved medical marijuana in 2012. Read More.
A new Tennessee law imposes new requirements on healthcare practitioner employers. Under certain circumstances, employers must promptly report positive drug test results to the state. This law is effective July 1, 2017. Read More.
Vermont’s Ban the Box law became effective on July 1, 2017. Employers who violate the law will be subject to a civil penalty of up to $100 per violation. However, employers may still question applicants about their criminal record during a job interview or once the applicant has been deemed otherwise qualified for the position. Read More.
Several employment laws in West Virginia go into effect as of July 7, 2017. These laws include the Second Chance for Employment Act, Unemployment Benefits Disqualification, and the Safer Workplace Act. Read More.
